Good questions. Straight answers.
Does California’s lemon law apply to my vehicle?
There’s a good chance it does. California has some of the strongest consumer protections in the country, and the lemon law usually covers new and used cars, trucks, SUVs, and vans that came with the manufacturer’s new-car warranty. It can also cover demo vehicles and some vehicles used for business. Contact us, and we’ll tell you where you stand.
What if the dealer can’t fix my vehicle?
Then the law is on your side. If a serious defect covered by the warranty isn’t fixed after a reasonable number of tries, the manufacturer generally has to replace your vehicle or refund what you paid, and the choice between the two is yours. Some deductions, such as an allowance for the miles you drove before the problem first appeared, may apply.
Timing matters. The sooner we see your repair history, the sooner we can build a strategy around it and put the manufacturer on notice, so call us as soon as the problem keeps coming back.
How many repair attempts is “reasonable”?
California gives you a head start. Your vehicle is generally presumed to be a lemon if, within 18 months or 18,000 miles of delivery, whichever comes first:
- The same problem wasn’t fixed after four or more tries.
- A defect that could cause death or serious injury wasn’t fixed after two or more tries.
- Your vehicle spent more than 30 days in the shop for warranty repairs. The days don’t have to be in a row.
If your situation doesn’t match these exactly, you may still have a strong claim. Your repair records often tell the story.
Will I have to go to court?
Often, no. A well-built case, pressed with skill and negotiated with purpose, frequently resolves without a courtroom. But we prepare every case as if it will be tried, and when a manufacturer won’t do what the law requires, we’re ready to take it to trial and pursue everything the law provides.
What does it cost to work with Lion Law?
Nothing up front. We take lemon law cases on contingency, so we’re paid only if your case succeeds. And when you win, California law requires the manufacturer to pay your attorney’s fees and costs. The law was built this way so that any driver can stand up to an automaker.
